Terms of service
Terms of Service
These Terms of Service govern bookings, yacht charter services and use of the YCN Miami website and related services provided by YCN Miami.
1. About YCN Miami
Depending on the charter, YCN Miami may act as a charter manager, central agent, booking intermediary or agent arranging access to yachts, captains, crew, transportation and related services provided by independent third parties.
Yacht availability, pricing, specifications, crew arrangements and charter terms may vary by vessel and are subject to confirmation.
2. Bookings & Deposits
Bookings should be made as early as possible to secure the preferred yacht, date and departure time.
Unless otherwise stated in writing, a booking may require a $1,000 deposit at the time of reservation. A booking is not confirmed until the required deposit or payment has been received and confirmation has been issued by YCN Miami.
Certain yachts, promotional offers, holidays, peak-demand dates, multi-day charters or third-party operators may require a different deposit, higher advance payment or full payment at booking. When such terms apply, they will be disclosed before confirmation.
3. Balance Payments
Any remaining charter balance must be paid by the deadline stated in the booking confirmation, invoice or charter agreement.
Failure to make the required payment by the applicable deadline may result in cancellation of the reservation and application of the cancellation terms described below.
4. Cancellation Policy
A payment toward a booking constitutes acceptance of the applicable cancellation policy. Cancellation requests must be submitted in writing.
Unless different cancellation terms are stated in the yacht-specific booking confirmation or charter agreement, the following schedule applies:
| Cancellation Date | Cancellation Charge |
|---|---|
| 61 days or more before departure | No cancellation penalty |
| 60 to 15 days before departure | 50% of the total charter cost |
| 14 to 7 days before departure | 75% of the total charter cost |
| Less than 7 days before departure | 100% of the total charter cost |
| After departure or during the charter | 100% of the total charter cost |
Certain special offers, holiday periods, promotional rates, term charters or third-party yacht operators may require non-refundable deposits or full non-refundable payment. Those terms will supersede the general schedule above when disclosed before booking.
5. Unused Services
No refund will be issued for services, charter time, accommodations, amenities, activities or other arrangements voluntarily unused by the guest after the charter has begun.
If a guest elects to terminate a charter early, no refund is due for the unused portion unless expressly agreed otherwise in writing.
Any other claim for reimbursement should be submitted to YCN Miami within 30 days following completion of the charter and should include supporting documentation where applicable.
6. Weather & Itinerary Changes
Yacht charters are subject to weather, sea conditions, mechanical conditions, navigation restrictions and the judgment of the vessel's captain.
Safety always takes priority over the planned itinerary. The captain may modify the route, destination, anchorage, departure time or activities when reasonably necessary for safety or operational reasons.
Inclement weather does not automatically entitle a guest to a refund unless cancellation is required under the applicable charter agreement or the yacht/operator's specific weather policy.
When circumstances make the originally booked yacht unavailable, YCN Miami may attempt to arrange a comparable replacement yacht or another reasonable alternative, subject to availability and guest approval where appropriate.
7. Fuel & Additional Charges
Charter rates include only those items specifically identified as included in the applicable product page, quote, invoice or charter agreement.
REinvest Ventures, LLC reserves the right to apply or adjust a fuel surcharge where permitted and where fuel pricing materially affects the operating cost of the charter.
Depending on the yacht and charter structure, additional charges may include fuel, dockage, provisioning, catering, beverages, crew gratuity, delivery or repositioning fees, permits, customs, cruising fees, transportation, water toys or other requested services.
8. Items Generally Not Included
Unless expressly stated otherwise, charter prices do not include:
- Airfare, ground transportation or accommodations ashore;
- Passports, visas, customs charges or immigration expenses;
- Food, alcohol, specialty beverages or catering;
- Personal purchases and expenses;
- Travel, health, accident, baggage or cancellation insurance;
- Crew gratuity;
- Additional dockage or marina charges;
- Services or activities not expressly stated as included.
9. Captain, Crew & Third-Party Services
Captains, crew members and other service providers may be independent contractors and are not necessarily employees of YCN Miami.
Where applicable, guests may be required to select and engage an appropriately licensed captain independently. YCN Miami may provide referrals or introductions to qualified professionals for the guest's consideration.
Third-party services remain subject to the terms, policies and requirements of the applicable provider.
10. Guest Conduct & Safety
Guests must follow all lawful and reasonable safety instructions issued by the captain or crew.
YCN Miami, the yacht owner, operator or captain may refuse boarding, terminate a charter or remove a guest where conduct presents a safety risk, threatens the vessel or other persons, materially interferes with operations, violates applicable law or substantially disrupts the experience of other guests.
Guests are responsible for damage caused by their intentional, reckless or negligent conduct, subject to the applicable charter agreement and law.
11. Alcohol, Illegal Substances & Prohibited Conduct
Guests are responsible for complying with all applicable federal, state, local and international laws.
Illegal drugs, unlawful activity, unsafe behavior, violence, harassment and possession of prohibited items are not permitted aboard the vessel.
Excessive intoxication or behavior creating a safety concern may result in termination of the charter at the captain's discretion without entitlement to a refund.
12. Passports, Visas & International Travel
Guests are solely responsible for ensuring that they possess all valid passports, visas, immigration approvals and other travel documents required for their itinerary.
YCN Miami is not responsible for denied boarding, denied entry, additional expenses or lost charter time resulting from incomplete or invalid travel documentation.
13. Personal Belongings & Insurance
Guests are responsible for their personal property. To the fullest extent permitted by law, YCN Miami is not responsible for personal belongings that are lost, stolen, damaged or left aboard a vessel.
Guests are encouraged to obtain appropriate travel, medical, accident, property and trip-cancellation insurance where desired.
14. Limitation of Responsibility
Except where expressly stated otherwise, YCN Miami may act as an agent or intermediary in arranging yachts, captains, crew, transportation, catering and other services provided by independent third parties.
To the fullest extent permitted by applicable law, YCN Miami will not be liable for the acts, omissions, negligence, delays, cancellations or failures of independent yacht owners, operators, captains, crew members, transportation providers, vendors or other third-party service providers.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.
15. Force Majeure
YCN Miami will not be responsible for failure or delay in performing obligations caused by circumstances beyond its reasonable control, including but not limited to:
- Hurricanes, tropical storms, floods, fire or other natural disasters;
- War, terrorism, civil unrest or government action;
- Pandemics, epidemics or public-health restrictions;
- Port closures, navigation restrictions or governmental orders;

20. Governing Law & Disputes
These Terms and any dispute arising from the use of this website or the services of YCN Miami shall be governed by the laws of the State of Florida, without regard to conflict-of-law principles.
Unless otherwise required by applicable law or agreed in a separate written charter agreement, disputes shall be brought in a court of competent jurisdiction located in Miami-Dade County, Florida.
21. Yacht-Specific Agreements
Certain charters may require execution of a yacht-specific charter agreement containing additional or different provisions concerning cancellation, weather, liability, deposits, damage, crew, gratuity, fuel, cruising areas or other matters.
Where a yacht-specific signed agreement conflicts with these general Terms of Service, the yacht-specific agreement will govern the charter to the extent of the conflict.
22. Changes to These Terms
YCN Miami may update these Terms of Service from time to time. Changes will become effective when published on this website unless otherwise stated.
Terms applicable to an existing confirmed booking will remain subject to the contractual documents governing that booking.
